Refunds and right of withdrawal
English below, Deutsch weiter unten. For consumers in Germany the German version governs.
Today there is nothing to refund. This website takes no payment. It has no shop, no checkout, no card field, and no subscription. The Overlap app is free while it is in testing. This page sets out what will apply the moment that changes, so nobody has to guess.
1. If you bought through the App Store or Google Play
When an app is sold through a store, the store is the seller you paid, not us. Ask them first, because only they can reverse the charge:
- Apple — request a refund at reportaproblem.apple.com. In Europe your contract is with Apple Distribution International Ltd., and Apple’s media terms govern the purchase.
- Google Play — request a refund at play.google.com. Google handles the first 48 hours automatically and passes later requests to us.
If the store turns you down and you think the app was genuinely faulty or not as described, write to hello@heylabapp.com and we will look at it ourselves. Your statutory rights against the store are not affected by anything on this page.
2. If we ever sell to you directly
If we sell a subscription or a licence from this site to a consumer in the EU, you get a 14-day right of withdrawal under § 355 BGB. No reason is needed. The period starts the day the contract is concluded. To withdraw, send a clear statement to hello@heylabapp.com — an email saying you withdraw is enough. Sending it before day 14 ends is enough to keep the deadline. We refund within 14 days of being told, using the same payment method you used, at no charge to you.
One exception matters for software. For digital content and digital services, the right of withdrawal ends early if all three of these are true (§ 356 (4) and (5) BGB): you expressly asked us to start immediately, you confirmed you understood that starting immediately costs you the withdrawal right, and we sent you that confirmation in writing. We will only ask for that if you actually want immediate access, and we will never bury it in a pre-ticked box.
Beyond the statutory minimum: if a paid plan is withdrawn or closed by us mid-term, we refund the unused portion pro rata.
3. Product and design work for companies
Studio engagements are business-to-business. They are not consumer distance contracts, so the 14-day withdrawal right does not apply. Fees, milestones, cancellation, and what happens to work already delivered are agreed in the written contract for that engagement, and that contract prevails over this page.
4. What we will not do
We will not keep money for a service that never worked, and we will not make you argue for a refund you are legally owed. If the answer is no, you will get the reason in writing and a pointer to who to escalate to.
5. A note on images and provenance
Not a refund matter, but it belongs somewhere findable. Everything drawn on this site — the mark, the field, the haystacks, the 404 page — is hand-written SVG or canvas code rather than licensed stock artwork, so there is no third-party image licence to breach. The typefaces are open source under the SIL Open Font License 1.1 and are served from our own domain with their licence texts alongside them at /fonts/.
The one exception is the app icon logo.png, which was generated with an image model (OpenAI gpt-image) and still carries its signed C2PA Content Credentials, including the IPTC marker for synthetic media. We have the right to use it commercially. The catch is the other direction: purely machine-generated artwork is unlikely to attract copyright of its own in Germany, because § 2 (2) UrhG requires a human intellectual creation. In practice that means we could not stop somebody copying that icon on copyright grounds. Protecting a logo properly means registering it as a trade mark.

Derzeit gibt es nichts zu erstatten. Diese Website nimmt keine Zahlungen entgegen. Es gibt keinen Shop, keine Kasse, kein Kartenfeld und kein Abonnement. Die App Overlap ist während der Testphase kostenlos. Diese Seite hält fest, was gilt, sobald sich das ändert.
1. Kauf über den App Store oder Google Play
Wird eine App über einen Store verkauft, ist der Store Ihr Vertragspartner, nicht wir. Wenden Sie sich zuerst dorthin, denn nur dort kann die Zahlung rückabgewickelt werden:
- Apple — Erstattung beantragen unter reportaproblem.apple.com. In Europa besteht Ihr Vertrag mit der Apple Distribution International Ltd.; es gelten die Medienbedingungen von Apple.
- Google Play — Erstattung beantragen unter play.google.com. Google entscheidet innerhalb der ersten 48 Stunden automatisch und leitet spätere Anträge an uns weiter.
Lehnt der Store ab und war die App aus Ihrer Sicht tatsächlich mangelhaft oder nicht wie beschrieben, schreiben Sie an hello@heylabapp.com; wir prüfen es dann selbst. Ihre gesetzlichen Rechte gegenüber dem Store bleiben unberührt.
2. Direktverkauf durch uns
Verkaufen wir einem Verbraucher in der EU ein Abonnement oder eine Lizenz unmittelbar über diese Seite, steht Ihnen ein 14-tägiges Widerrufsrecht nach § 355 BGB zu. Gründe müssen Sie nicht nennen. Die Frist beginnt mit Vertragsschluss. Für den Widerruf genügt eine eindeutige Erklärung an hello@heylabapp.com; eine E-Mail mit dem Wortlaut, dass Sie widerrufen, reicht aus. Zur Fristwahrung genügt die rechtzeitige Absendung. Wir erstatten innerhalb von 14 Tagen nach Zugang des Widerrufs über dasselbe Zahlungsmittel, das Sie verwendet haben, ohne Kosten für Sie.
Für Software gilt eine wichtige Ausnahme. Bei digitalen Inhalten und digitalen Dienstleistungen erlischt das Widerrufsrecht vorzeitig, wenn alle drei Voraussetzungen vorliegen (§ 356 Abs. 4 und 5 BGB): Sie haben ausdrücklich verlangt, dass wir sofort beginnen, Sie haben bestätigt, dass Sie damit Ihr Widerrufsrecht verlieren, und wir haben Ihnen dies in Textform bestätigt. Wir fragen das nur ab, wenn Sie den sofortigen Zugang tatsächlich wünschen, und niemals über ein vorangekreuztes Kästchen.
Über das gesetzliche Minimum hinaus: Kündigen oder schließen wir einen bezahlten Zugang während der Laufzeit, erstatten wir den nicht genutzten Anteil zeitanteilig.
3. Produkt- und Designarbeit für Unternehmen
Studioaufträge sind Geschäfte zwischen Unternehmen. Sie sind keine Verbraucher-Fernabsatzverträge, sodass das 14-tägige Widerrufsrecht nicht gilt. Vergütung, Meilensteine, Kündigung und der Umgang mit bereits erbrachten Leistungen werden im schriftlichen Vertrag des jeweiligen Auftrags geregelt; dieser geht dieser Seite vor.
4. Was wir nicht tun
Wir behalten kein Geld für eine Leistung, die nie funktioniert hat, und Sie müssen um eine Erstattung, die Ihnen zusteht, nicht streiten. Fällt die Antwort negativ aus, erhalten Sie die Begründung schriftlich und einen Hinweis auf die nächste Stelle.
5. Hinweis zu Bildern und Herkunft
Kein Erstattungsthema, aber es gehört an eine auffindbare Stelle. Alles Gezeichnete auf dieser Seite — die Marke, das Feld, die Heuhaufen, die 404-Seite — ist selbst geschriebener SVG- oder Canvas-Code und keine lizenzierte Stockgrafik; es gibt also keine fremde Bildlizenz, gegen die verstoßen werden könnte. Die Schriften sind Open Source unter der SIL Open Font License 1.1 und werden mit ihren Lizenztexten unter /fonts/ von unserer eigenen Domain ausgeliefert.
Einzige Ausnahme ist das App-Icon logo.png. Es wurde mit einem Bildmodell erzeugt (OpenAI gpt-image) und trägt weiterhin seine signierten C2PA-Herkunftsdaten einschließlich der IPTC-Kennzeichnung für synthetische Medien. Die gewerbliche Nutzung steht uns zu. Der Haken liegt in der Gegenrichtung: Rein maschinell erzeugte Grafik dürfte in Deutschland keinen eigenen Urheberrechtsschutz genießen, da § 2 Abs. 2 UrhG eine persönliche geistige Schöpfung voraussetzt. Praktisch heißt das: Wir könnten einer Übernahme dieses Icons urheberrechtlich nicht entgegentreten. Wirksamer Schutz eines Logos setzt eine Markenanmeldung voraus.
